Welcome to EverAmp. EverAmp is a brand operated by Shandong Maxtop Innovations Technology Co. Ltd. (“EverAmp,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of everamppower.com (the “Site”) and your purchase of products from EverAmp.

By visiting the Site, placing an order, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use the Site or purchase our products.

1. Eligibility

By using the Site, you represent that you are at least the age of majority in your state or place of residence and are legally able to enter into a binding agreement.

You may not use our products or services for any unlawful or unauthorized purpose.

2. Online Store Terms

We reserve the right to refuse or cancel service or orders where reasonably necessary, including in cases involving suspected fraud, unauthorized transactions, pricing errors, product availability, violations of these Terms, or misuse of the Site.

You agree to provide current, complete, and accurate information when placing an order. You are responsible for reviewing your contact, billing, and shipping information before submitting the order.

3. Product Information

We make reasonable efforts to display product descriptions, specifications, images, colors, compatibility information, and other details as accurately as possible.

However, product appearance may vary slightly because of screen settings, production updates, photography, or other factors. Minor differences that do not materially affect the product’s function are not considered defects.

We may update product designs, packaging, specifications, or included components when reasonably necessary, provided that the product’s essential functionality is not materially reduced.

Please review the product description, specifications, compatibility requirements, and user instructions before purchasing or using a product.

4. Prices and Payment

Prices are displayed in U.S. dollars unless otherwise stated.

Prices, promotions, discounts, and product availability may change without notice. A price or promotion shown at one time does not guarantee that the same price will remain available later.

Applicable taxes will be calculated and displayed during checkout where required.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment providers to charge the total amount shown at checkout.

5. Orders and Acceptance

Submitting an order does not automatically mean that the order has been accepted.

We may verify payment, shipping information, inventory availability, and other order details before accepting or fulfilling an order. An order is considered accepted when it enters fulfillment or is shipped.

We reserve the right to limit quantities or cancel an order because of:

  • Product unavailability

  • Incorrect pricing or product information

  • Payment authorization issues

  • Suspected fraud or unauthorized activity

  • Shipping restrictions

  • Violations of these Terms

If we cancel an order after payment has been collected, we will issue a refund for the canceled portion to the original payment method.

6. Order Cancellations

If you need to cancel an order, please contact us as soon as possible.

Orders that have not entered warehouse processing may be canceled for a full refund without a cancellation fee.

Once an order has entered fulfillment or has been shipped, we cannot guarantee that it can be canceled or intercepted. If cancellation is no longer possible, the order may be handled according to our Refund and Return Policy after delivery.

7. Shipping and Delivery

Shipping coverage, processing times, estimated delivery times, fulfillment partners, tracking, address changes, and delivery issues are governed by our Shipping Policy.

Delivery dates are estimates unless expressly stated otherwise. If we cannot ship an order within the stated period, we will provide notice and, when applicable, offer the choice to accept a revised shipping date or cancel the affected order for a refund.

You are responsible for providing a complete and accurate delivery address.

8. Returns, Refunds, and Exchanges

Returns, refunds, cancellations, and eligible replacement requests are governed by our Refund and Return Policy.

Standard 30-day returns are limited to eligible unused and undamaged products returned in their original packaging with all included components.

Products that have been opened or used and are suspected of having a quality issue will be evaluated and handled under the applicable EverAmp Warranty Policy.

Before returning a product, you must contact EverAmp Customer Support for authorization and the correct return instructions. Because orders may be fulfilled from different warehouses, return addresses may vary.

9. Product Use and Safety

EverAmp products must be installed, operated, stored, and maintained according to the applicable product manual, safety instructions, technical specifications, and warnings.

You are responsible for confirming that a product is suitable and compatible with your intended equipment, environment, electrical load, and application.

Do not exceed the product’s rated capacity or use the product in unsafe, prohibited, or unsupported conditions.

Unless a product is expressly designed, certified, and marketed for such use, EverAmp products must not be used as the sole power-protection system for life-support equipment, emergency medical systems, or other applications where product failure could reasonably result in death, personal injury, or severe property damage.

Damage resulting from misuse, improper installation, unauthorized modification, accidents, excessive load, unsuitable operating conditions, or failure to follow product instructions may not be covered by warranty.

10. Warranty

Eligible EverAmp products are covered according to the warranty terms applicable to the specific product.

Warranty coverage does not replace or limit any consumer rights that cannot lawfully be excluded. Warranty service may require proof of purchase, product information, photographs, video evidence, troubleshooting, or return of the affected product.

11. Promotions and Discount Codes

Promotions, discount codes, coupons, gifts, and limited-time offers may be subject to additional conditions, including eligibility requirements, quantity limits, expiration dates, and restrictions on combining offers.

Unless otherwise stated, promotional offers:

  • Have no cash value

  • Cannot be applied retroactively

  • Cannot be combined with other offers

  • May be limited to selected products or customers

  • May be changed or ended where permitted by law

If a promotion contains an obvious error or is used fraudulently, we may reject or cancel the affected transaction.

12. Accuracy of Website Information

We make reasonable efforts to keep the Site accurate and current. Occasionally, information may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping, availability, or other details.

14. Reviews and User Content

If you submit a product review, photograph, comment, suggestion, or other content to EverAmp, you represent that:

  • You created the content or have permission to submit it

  • The content is truthful and based on your genuine experience

  • The content does not violate another person’s rights

  • The content is not unlawful, misleading, abusive, or harmful

You grant EverAmp a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and share submitted content for operating, improving, and promoting our business and products, subject to applicable law.

We may remove content that violates these Terms, but we are not obligated to monitor all user submissions.

15. Intellectual Property

The Site and its contents—including text, graphics, product images, videos, logos, icons, page layouts, and software—are owned by or licensed to EverAmp and are protected by applicable intellectual property laws.

You may access and use the Site only for personal, non-commercial shopping and informational purposes.

Without prior written permission, you may not copy, reproduce, modify, distribute, publish, sell, scrape, reverse engineer, or commercially exploit the Site or its contents.

16. Prohibited Conduct

You may not use the Site:

  • For unlawful, fraudulent, or abusive activity

Product warranties are limited to those expressly provided in the applicable EverAmp Warranty Policy. Nothing in these Terms excludes warranties, rights, or remedies that cannot legally be excluded.

18. Limitation of Liability

To the maximum extent permitted by applicable law, EverAmp will not be liable for indirect, incidental, special, exemplary, or consequential losses resulting from the use of the Site or products, including loss of profits, business interruption, or loss of data.

EverAmp’s total liability arising from a product purchase will not exceed the amount paid for the product giving rise to the claim, except where a different limitation is required by applicable law.

These limitations do not apply to liability that cannot legally be limited or excluded.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold EverAmp harmless from claims, losses, liabilities, and reasonable expenses resulting from your unlawful use of the Site, material violation of these Terms, or infringement of another party’s rights.

This section does not apply to claims caused by EverAmp’s own violation of applicable law.

20. Privacy

Our collection, use, disclosure, and protection of personal information are governed by our Privacy Policy.

By using the Site, you acknowledge that your information may be processed as described in that policy.

21. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law. The remaining provisions will continue in effect.

22. No Waiver

If EverAmp does not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

23. Changes to These Terms

We may update these Terms from time to time to reflect changes in our products, services, business practices, or legal requirements.

The revised version will be posted on this page with an updated effective date. Changes will apply prospectively unless otherwise required by law.

Your continued use of the Site after revised Terms take effect constitutes acceptance of the updated Terms.

24. Entire Agreement

These Terms, together with the policies and notices posted on the Site, constitute the agreement between you and EverAmp concerning your use of the Site and purchases made through it.

If another posted policy specifically addresses a subject covered by these Terms, the more specific policy will apply to that subject.
